These Terms and Conditions govern access to and use of the KLiK AFRiKA website and marketplace, including purchases made through the platform.
By accessing KLiK AFRiKA, creating an account or placing an order, you agree to these Terms and Conditions. Nothing in these terms is intended to exclude or restrict rights that cannot lawfully be excluded under South African consumer law. The Consumer Protection Act prohibits certain terms that improperly waive consumer rights or exclude liability, including for gross negligence.
1. About KLiK AFRiKA
KLiK AFRiKA is a multi-vendor online marketplace that provides a digital platform through which independent African sellers can showcase and sell products to customers.
Unless specifically stated otherwise, products displayed on the marketplace are offered by independent sellers. The applicable seller is identified on the relevant product or store page.
KLiK AFRiKA provides marketplace infrastructure and facilitates transactions between customers and sellers but does not manufacture every product offered through the marketplace.
2. Using the Marketplace
You may browse KLiK AFRiKA for personal and lawful purposes.
You may not use the platform to engage in fraud, interfere with its operation, gain unauthorised access to accounts or systems, distribute malicious software, scrape or reproduce marketplace content unlawfully, or use KLiK AFRiKA for any activity prohibited by applicable law.
We may restrict or suspend access where reasonably necessary to protect customers, sellers, the marketplace or other users.
3. Customer Accounts
Where you create an account, you are responsible for providing accurate information and keeping your login details secure.
You are responsible for activity conducted through your account unless the activity results from circumstances for which you are not legally responsible.
Please notify KLiK AFRiKA if you believe your account has been accessed without authorisation.
4. Independent Sellers
KLiK AFRiKA hosts multiple independent sellers.
Sellers are responsible for the products they list, including the accuracy of product descriptions, pricing, availability, stock information and fulfilment of their orders.
KLiK AFRiKA may establish marketplace standards, review listings, remove inappropriate products or sellers and assist in resolving marketplace disputes.
Where applicable law places an obligation directly on KLiK AFRiKA, these Terms do not remove that obligation.
5. Products, Information and Pricing
Sellers are expected to provide clear and accurate information about their products.
Product photographs are intended to represent products as accurately as reasonably possible, but colours and appearance may vary depending on lighting, photography and the customer’s device.
Prices are displayed in the currency indicated on the website.
Any applicable delivery charges or other charges will be presented to the customer during the ordering process where applicable.
If a material pricing or listing error is discovered, the affected customer will be informed and the matter handled in accordance with applicable law.
6. Orders
Adding an item to your cart does not reserve that product.
Before completing an order, customers should review the products, quantities, delivery information and total amount payable.
South African electronic-commerce rules include requirements designed to allow consumers to review a transaction, correct mistakes and withdraw before finally placing an order.
Once an order has been successfully placed, the customer should receive an order confirmation through the contact details provided during checkout.
An order may be affected by stock availability, payment failure, suspected fraud, incorrect information or other legitimate circumstances.
Where an order cannot be fulfilled, the customer will be informed and any refund legally due will be processed.
7. Payments
Orders must be paid using one of the payment methods made available at checkout.
KLiK AFRiKA does not offer Cash on Delivery.
Payment information may be processed through third-party payment providers. The payment methods available to customers will be displayed during checkout.
KLiK AFRiKA will take reasonable steps to use appropriate payment and security infrastructure. South African electronic-commerce law requires suppliers to use payment systems sufficiently secure for the transaction concerned.
8. Shipping and Delivery
Shipping options, charges and delivery availability may vary depending on the seller, product, destination, shipment weight and other fulfilment requirements.
Applicable shipping charges are displayed during checkout.
Because KLiK AFRiKA is a multi-vendor marketplace, products purchased from different sellers may be packaged and delivered separately.
Estimated delivery periods are estimates unless expressly stated otherwise.
Customers are responsible for providing complete and accurate delivery information.
Further details are provided in our Shipping Policy.
9. Returns, Refunds and Cancellations
Returns and refunds are handled in accordance with applicable South African consumer law and the KLiK AFRiKA Refund & Returns Policy.
Nothing in our marketplace policies removes a consumer right provided by law.
The Consumer Protection Act provides important remedies for goods that fail applicable quality standards, while electronic transactions can also carry statutory cancellation rights in specified circumstances.
Some products may be subject to lawful return restrictions because of their nature, including certain opened hygiene, beauty, personalised or perishable products.
Customers should consult the Refund & Returns Policy before requesting a return.
10. Seller Membership and Marketplace Fees
Businesses selling through KLiK AFRiKA are subject to separate seller requirements and applicable membership terms.
Our current seller model includes an introductory R49 per month for the first three months, followed by the seller’s selected Basic, Standard or Premium membership.
A 5.5% marketplace commission applies to successful sales across all seller plans.
Seller membership fees, product limits, commissions, withdrawals and other seller obligations will be governed by the applicable Seller Terms & Conditions and membership information.
These customer Terms & Conditions do not replace the separate agreement between KLiK AFRiKA and its sellers.
11. Reviews and User Content
Customers may be able to submit reviews, ratings or other content.
Content submitted to KLiK AFRiKA must be genuine, lawful and relevant. Users may not submit fraudulent reviews, abusive material, unlawful content, malicious content or material that infringes another person’s rights.
KLiK AFRiKA may moderate or remove content where reasonably necessary to protect the integrity of the marketplace.
12. Intellectual Property
Unless otherwise indicated, the KLiK AFRiKA name, branding, website design and original platform content belong to KLiK AFRiKA or are used with appropriate permission.
Individual sellers retain responsibility for the intellectual property associated with their own brands, products, photographs and other seller-provided content.
You may not reproduce, commercially exploit or distribute protected marketplace content without appropriate permission.
13. Prohibited Products and Activity
Sellers and users may not use KLiK AFRiKA to sell, promote or facilitate illegal goods, counterfeit products, stolen goods, fraudulent products or other products prohibited by KLiK AFRiKA policies or applicable law.
KLiK AFRiKA reserves the right to remove listings or restrict accounts that violate marketplace requirements.
14. Platform Availability
We aim to keep KLiK AFRiKA available and functioning reliably, but uninterrupted access cannot be guaranteed.
The marketplace may occasionally be unavailable because of maintenance, updates, hosting problems, security incidents or circumstances outside our reasonable control.
Where reasonably possible, we will work to restore affected services promptly.
15. Liability
KLiK AFRiKA will take reasonable steps to operate the marketplace responsibly and provide the services described on the platform.
However, nothing in these Terms should be interpreted as unlawfully excluding or limiting liability or consumer rights that cannot legally be excluded.
In particular, South Africa’s Consumer Protection Act restricts contractual terms that attempt to exclude liability for gross negligence or improperly waive statutory consumer protections.
Where permitted by law, liability will be determined according to the circumstances of the transaction, the role of the relevant seller and KLiK AFRiKA, and applicable legislation.
16. Privacy and Personal Information
KLiK AFRiKA processes personal information required to operate the marketplace, process transactions, provide customer support, administer accounts and perform related legitimate functions.
Our handling of personal information is explained separately in the KLiK AFRiKA Privacy Policy.
Customers and sellers should read that policy together with these Terms.
17. Changes to These Terms
KLiK AFRiKA may update these Terms from time to time to reflect changes to the marketplace, our services or applicable requirements.
The latest version will be published on this page together with an updated revision date.
Changes will not retrospectively remove rights that have already accrued where doing so would be unlawful.
18. Governing Law
These Terms are governed by the laws of the Republic of South Africa.
Nothing in this clause prevents a consumer from exercising rights or using dispute-resolution mechanisms available under applicable consumer-protection legislation.
South Africa’s Consumer Protection Act establishes protections relating to fair marketplace practices and consumer transactions.
19. Contact KLiK AFRiKA
If you have questions about these Terms, an order or your use of the marketplace, please contact us through our Contact KLiK AFRiKA page.
Customers should include their order number where the enquiry relates to an existing purchase.
